TERMS AND CONDITIONS
1 - Your Dues Based Membership entitles you to your sessions per month during the term of your membership (“membership services”) once each monthly payment has been made. Your Paid in Full membership allows you to redeem all membership services immediately or as desired throughout the term of your membership. Each session includes ten minutes for client consultation. Your membership status must be active in order to redeem any membership services or membership pricing. Your membership serves are not transferrable to any other person or entity. Picture ID is required to establish membership enrollment in your home state. In the event of a change in your circumstances, you may apply to temporarily freeze your membership. Please see the front desk for eligibility, terms and conditions.
2 - You may cancel your membership only in the event that: (a) you permanently relocate your residence more than 25 miles away from your original residence and such relocation also puts you more than 25 miles away from any iLash Studio location; or (b) a physician certifies that you are unable to receive eyelash extensions. All cancellation requests MUST be accompanied by written proof of relocation (e.g., executed Mortgage or Rental agreement, utility bill, car insurance) or submission of your Physician’s statement that you can no longer receive lash extensions. All cancellation requests must be submitted in writing and will become effective 30 days from the date the cancellation request was processed. Payments due prior to the effective date will be charged as scheduled. You may use any accrued membership services for 60 days after your final membership payment has been processed. No refunds will be given for any remaining unused sessions. If you have paid in full for membership services, you will be refunded the future unused portion of your membership dues for any membership services you have not yet redeemed. If you die or become disabled such that you are unable to redeem all of your membership services, you and/or estate will be relieved from making payment for membership services other than those you received prior to your death or disability. You may cancel this membership during the renewal term of the membership upon 30 day advance written notice to the iLash Studio where your membership originated. You are responsible for any and all membership fees incurred until your membership is cancelled in accordance with the terms of this agreement. All cancellations and refunds under this section are effective upon the date of approval by the originating studio of the proper documentation. All refunds will be for the months of membership remaining after the effective date of cancellation.
3 - We reserve the right to terminate or deny re-enrollment for an indeterminate amount of time if a customer has an unsatisfactory payment history.
4 - Inappropriate or illegal behavior by clients or staff will not be tolerated in any manner. We request that you immediately notify the Studio Management about inappropriate behavior. We have the right to refuse or discontinue service at any time for any reason. You agree to follow all studio rules and regulations. Violation of studio rules and regulations may result in suspension or cancellation of your membership. You will be responsible for payment in full upon revocation of membership.
5 - We reserve the right to collect at any time any delinquent or outstanding balance(s) that have not been paid for any services provided or fees owed. For purposes of identification and billing, you agree to provide us with current, accurate, complete and updated information including your name, address, telephone number, email and applicable payment data. You agree to notify us promptly of any changes of your membership data. Except as expressly provided herein, we may modify our services or the terms and conditions of this agreement at any time without notice and modifications shall be deemed effective immediately upon making such changes. If we change the amount to be periodically billed to your account as specified in the Membership Agreement and Payment Section of this agreement we will send you a notice of change at the mailing and/or email address you have provided in this agreement at least ten days prior to the effective date of such change.
6 - DISCLAIMER OF LIABILITY - The iLash Studio only hires professional estheticians who comply with state, city, and/or local licensing requirements. If you would like to see particular esthetician’s license or registration, please contact the Studio Manager. Additionally, if you have any questions, comments or complaints about your esthetician, please bring this to the attention of management immediately.
It is your responsibility to inform the esthetician of any pre-existing conditions, limitations or specific sensitivities as well as to inform your esthetician if you feel any discomfort during the session. In the event that you experience discomfort, please inform the esthetician immediately.
YOU UNDERSTAND AND VOLUNTARILY ACCEPT ANY RISKS ASSOCIATED WITH YOUR SERVICE OR ANY USE OF THE STUDIO FACILITIES. EXCEPT WHERE PROHIBITED BY LAW, YOU AGREE THAT THE iLASH STUDIO WILL NOT BE LIABLE FOR ANY INJURY, INCLUDING, WITHOUT LIMITATION, PERSONAL, BODILY, OR MENTAL INJURY, ECONOMIC LOSS, OR ANY DAMAGE TO YOU RESULTING FROM NEGLIGENCE, OTHER ACTS OF THE STUDIO, ANYONE ON THE STUDIO’S BEHALF, OR ANYONE USING THE SERVICES OF THE STUDIO FACILITIES.
The iLash Studio is not responsible for lost or stolen articles or items.
Entire Agreement: This Agreement together with The iLash Studio’s Rules and Regulations posted in the TERMS AND CONDITIONS section of the www.theilashstudio.com website, constitute the entire agreement between you and us.
7 - OTHER RIGHTS - We may delay enforcing any of our rights without losing them. We can enforce this Agreement against your heirs and legal representatives. We may assign or transfer this Agreement or any of our rights under this Agreement without notice to you, except as otherwise required by law. Your rights or obligations under this Agreement cannot be assigned by you to anyone else without our prior written consent.
YOU ARE ENTITLED TO A COPY OF THIS AGREEMENT AT THE TIME YOU SIGN IT. YOU MAY CANCEL THIS AGREEMENT AT
ALL CANCELLATION REQUESTS MUST INCLUDE:
SEND A SIGNED AND DATED WRITTEN NOTICE OF CANCELLATION BY REGISTERED MAIL, RETURN RECEIPT REQUESTED; OR
PERSONALLY DELIVER A SIGNED AND DATED WRITTEN NOTICE OF CANCELLATION TO THE STUDIO.
